  • Support you in resolving claim processing issues within agreed timelines.
  • Comply with all applicable laws and regulations related to healthcare and data privacy, including HIPAA and the HITECH Act.

5. Payment and Billing

  • Fees for our services will be outlined in the contract or agreement.
  • Payments must be made as per the agreed schedule.
  • Refunds (if applicable) will be processed according to the terms of your contract.

6. Limitations of Liability

Medivo strives to provide the highest quality services. However, Medivo is not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of our services, even if Medivo has been advised of the possibility of such damages. Medivo is also not responsible for delays or issues caused by external factors, such as inaccurate data provided by you, third-party systems outside our control, or force majeure events (including but not limited to acts of God, natural disasters, acts of government, and war).

7. Messaging Terms and Conditions

General

When you opt-in to our messaging service, we will send you a message to confirm your signup.

By opting into messages, you agree to receive recurring automated marketing and informational text messages from Medivo for our services. Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.

Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Medivo. Medivo reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Medivo also reserves the right to change the short code or phone number where messages are sent.

Message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Your wireless provider is not liable for delayed or undelivered messages.

Your consent to receive marketing messages is not a condition of purchase.

Carriers

Carriers are not liable for delayed or undelivered messages.

Cancellation

You can cancel at any time by texting "STOP". After you send the SMS message "STOP", we will send you a message to confirm that you have been unsubscribed and that no more messages will be sent. If you would like to receive messages from Medivo again, just sign up as you did the first time, and Medivo will start sending messages to you again.

Transfer of Number

You agree that before changing your mobile number or transferring your mobile number to another individual, you will either reply "STOP" from the original number or notify us of your old number at +1 (302) 570-4020. The duty to inform us based on the above events is a condition of using this service to receive messages.

Messaging Terms Changes

We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. Your continued enrollment following such changes shall constitute your acceptance of such changes.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware.

These Terms and Conditions constitute the entire agreement between you and Medivo regarding the use of our services and supersede all prior communications and agreements, whether written or oral.

11. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms and Conditions shall be resolved through Mediation/Arbitration in Delaware.
